The Iowa Supreme Court heard oral arguments last week in a case that could determine the constitutionality of Iowa’s law that is designed to protect the state’s livestock farms from certain nuisance lawsuits.

The Supreme Court is considering the constitutionality of the law in the case of Valley View Swine LLC, a farm in Wapello County. Before trial, a Wapello County district court judge ruled that the defendants, Valley View and JBS Live Pork, didn’t have a statutory defense from the nuisance lawsuit because Iowa’s law providing protection from such lawsuits is unconstitutional.
