The 8th Circuit Court of Appeals ruled on June 5, 2025, in favor of Summit's challenge of the pipeline regulations in the Story and Shelby County zoning ordinances. The Appeals Court held that counties are federally preempted from adopting ordinances which include setback requirements, emergency plan requirements, and abandonment provisions for pipelines.
