Federal Judge Stopped WOTUS in Its Tracks Last Week

District Court Judge Ralph Erickson granted a preliminary injunction last week, (August 24-28,2015) which stops the WOTUS rule temporarily from going into effect in Alaska, Arizona, Arkansas, Colorado, Idaho, Missouri, Montana, Nebraska, Nevada, New Mexico, North Dakota, South Dakota and Wyoming.
“Based on evidence presented so far, Chief Judge Erickson found that the EPA granted itself powers that ‘do not bear any effect on the “chemical, physical and biological integrity”’ of the waters it is bound to protect,” AFBF President Bob Stallman said in a statement Friday August 28, 2015. “We could not agree more: The so-called Clean Water Rule is yet another example of EPA’s reckless and unlawful behavior in the face of science, economics and the law.”Want more news on this topic?
