Iowa DOT illegally issuing speeding tickets says Iowa judge

An officer from Iowa’s transportation department did not have legal authority to issue a speeding ticket to a 16-year-old driver, Polk County District Court Associate Judge Heather Lauber ruled Thursday.
The decision dismissing the ticket against Peyton Atzen, a student at Southeast Polk High School, is likely to be appealed.
But if the ruling stands, legal challenges to tens of thousands of tickets issued by Iowa Department of Transportation officers could follow with millions of dollars at stake.
"Today’s ruling is the beginning rather than the end of this issue," said Brandon Brown, Atzen's attorney. Brown said he will ask the court to issue an injunction forbidding DOT officers from making such stops in the future.
